1. Introduction

These Terms of Service apply when the company Breath-Pharmacy , (hereinafter "Breath-Pharmacy" ) provides its breathing courses through their application and website, breath- pharmacy.com.

Customer means the party who has a registered account on breath-pharmacy.com.

The Service refers to the breathing courses provided on the breath-pharmacy.com domain/website.

The Terms of Service, together with activation of the Service (as defined below), constitute the entire agreement between the parties (the Agreement).

The customer undertakes through the agreement to follow the terms of service and any other rules and instructions that breath-pharmacy.com may announce regarding the Service. Breath-Pharmacy provides current terms of service on the website and the customer is obliged to keep informed of any changes to these at all times. The customer is also obliged to observe applicable laws, regulations and authority decisions when using the service.

3. Ordering the Service

The customer can order the Service at breath-pharmacy.com. Ordering requires that the Customer has an account. This is done via the app (breath-pharmacy.com). Full prices are listed on the price page .

Ordering is done using the Stripe, Inc service.

Stripe

The customer has the choice to buy access to the courses via subscription, the purchase is made with Stripe, Inc inside "Media/Subscriptions".

  • You must be over 18 years of age to enter into an agreement.
  • The agreement shall be deemed to have been entered into between the Parties when the Customer has placed his order and accepted the terms of service.
  • The customer is responsible for ensuring that the information provided when ordering the Service is correct and complete. The customer must immediately notify Breath-Pharmacy if there are any changes to this information. Current contact details can be found at Contant .
  • The customer is responsible for ensuring that their account and login details are protected and used in a safe manner. The customer may not share their login details with anyone else. The Customer is responsible for all use of the Service made using its account and login details.
  • The customer undertakes not to use the Service in a way that may cause damage, interfere, overload or otherwise affect the Service or Breath-Pharmacy's system or network. The Customer undertakes not to attempt to gain unauthorized access to the Service, accounts or other information belonging to Breath-Pharmacy or other users.
  • The customer is responsible for paying the fees connected to the Service, the fees are shown on Breath-Pharmacy's website or the app and can be changed with reasonable notice.

4. Fees and Payment

To use Breath-Pharmacy's Service, it is necessary to pay fees according to current prices for the courses in: classes and courses. . The customer is responsible for paying the fees that are applicable for the use of the Service according to the applicable prices and payment terms. Breath-Pharmacy reserves the right to change its fees at any time, provided that the Customer will be notified of any changes in advance. The customer is responsible for ensuring that the payment information is correct and that there are sufficient funds on the payment card or account used to pay the fees. In case of late or non-payment, Breath-Pharmacy may have the right to take measures, such as blocking use of the Service or suspending the Customer from using the Service.

5. Changes and termination of the Service

Breath-Pharmacy reserves the right to change, update or terminate the Service or parts of the Service at any time and without prior notice. Breath-Pharmacy has no responsibility for any damages that may arise as a result of such changes or termination of the Service. The customer can close their account and stop using the Service at any time. To terminate the Service, the Customer must contact Breath-Pharmacy via contact and follow the instructions provided.

Any fees paid are non-refundable. Therefore, the distance contract law (Law (2005:59)) can not be applied. Breath-Pharmacy.com has the right to terminate the agreement with immediate effect if the Customer violates the terms of service or if the Customer uses the Service in an unauthorized or unauthorized manner.

6. Complaint

The customer has the right to complain about inaccuracies or shortcomings in the Service. Complaints must be made within a reasonable time after the Customer discovers or should have discovered the error or deficiency. Continued use of the Service after changes have entered into force means that the Customer accepts the new terms of service.

11. Dispute resolution and applicable law

These terms of service shall be interpreted and applied in accordance with Swedish law. Any disputes that arise due to these terms of service must be resolved in the first place by negotiation between the parties. If the parties cannot resolve the dispute through negotiation, the dispute shall be settled by a general court with the Gothenburg district court as the first instance.

12. Miscellaneous

If any provision in these terms of service is deemed invalid or unenforceable, this shall not affect the validity or enforceability of the other provisions. Breath-Pharmacy's failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
